Article 1052 of the French Code of civil procedure

The case is communicated to the public prosecutor’s office for its opinion.

When the application is made by the Public Prosecutor or a third party, the person whose civil status is in question or their heirs shall be heard or called. To this end, the application shall state their surname, first name, domicile, date and place of birth without prejudice to the particulars provided for by the 3° of Article 54.

L’affaire est communiquée pour avis au ministère public.

Lorsque la demande est formée par le procureur de la République ou un tiers, la personne dont l’état civil est en cause ou ses héritiers sont entendus ou appelés. A cette fin, la demande indique leurs nom, prénom, domicile, date et lieu de naissance sans préjudice des mentions prévues par le 3° de l’article 54.
