Article 1061-1 of the French Code of civil procedure

In the event of a dispute over the conditions of the funeral, the matter shall be referred to the judicial court at the request of the earliest party using one of the methods provided for in Article 750.

It rules within twenty-four hours.

An appeal may be made within twenty-four hours of the decision to the first president of the court of appeal. The latter or his delegate is seised without formality and must rule immediately. The parties are not required to constitute a lawyer.

The decision, which is enforceable on the minute, is notified to the mayor responsible for enforcement.

En matière de contestation sur les conditions des funérailles, le tribunal judiciaire est saisi à la requête de la partie la plus diligente selon un des modes prévus à l’article 750.

Il statue dans les vingt-quatre heures.

Appel peut être interjeté dans les vingt-quatre heures de la décision devant le premier président de la cour d’appel. Celui-ci ou son délégué est saisi sans forme et doit statuer immédiatement. Les parties ne sont pas tenues de constituer avocat.

La décision exécutoire sur minute est notifiée au maire chargé de l’exécution.
