Article 1081 of the French Civil Code

Any gift inter vivos of present property, although made by marriage contract to the spouses, or to one of them, shall be subject to the general rules prescribed for gifts made on that account.

It may not be made for the benefit of unborn children, except in the cases set out in Chapter VI of this Title.

Toute donation entre vifs de biens présents, quoique faite par contrat de mariage aux époux, ou à l’un d’eux, sera soumise aux règles générales prescrites pour les donations faites à ce titre.

Elle ne pourra avoir lieu au profit des enfants à naître, si ce n’est dans les cas énoncés au chapitre VI du présent titre.
