Article 1090 of the French Code of civil procedure

The application, which does not state the facts giving rise to the application, must contain, on pain of inadmissibility:

1° The surname, first names, profession, residence, nationality, date and place of birth of each of the spouses; the date and place of their marriage; the same particulars, where applicable, for each of their children;

2° The information provided for in Article 1075;

3° An indication of the court before which the claim is brought;

4° The names of the lawyers instructed by the spouses to represent them, or of the lawyer they have chosen for this purpose by mutual agreement.

Under the same sanction, the application shall be dated and signed by each of the spouses and their lawyer.

Article 1090

La requête, qui n’indique pas les faits à l’origine de la demande, doit contenir, à peine d’irrecevabilité :

1° Les nom, prénoms, profession, résidence, nationalité, date et lieu de naissance de chacun des époux ; la date et le lieu de leur mariage ; les mêmes indications, le cas échéant, pour chacun de leurs enfants ;

2° Les renseignements prévus à l’article 1075 ;

3° L’indication de la juridiction devant laquelle la demande est portée ;

4° Le nom des avocats chargés par les époux de les représenter, ou de celui qu’ils ont choisi à cet effet d’un commun accord.

Sous la même sanction, la requête est datée et est signée par chacun des époux et leur avocat.
