Article 1090 of the French General Tax Code

The duties payable on judicial decisions to which the judicial agent of the State is a party are liquidated as a debit.

They are assimilated, for recovery, prosecution, procedure and prescription, to the principal of the sentence. However, if the Treasury is convicted, it is exempt from payment of the duties.

Les droits exigibles sur les décisions judiciaires auxquelles est partie l’agent judiciaire de l’Etat sont liquidés en débet.

Ils sont assimilés pour le recouvrement, les poursuites, la procédure et la prescription, au principal de la condamnation. Toutefois, si le Trésor est condamné, il est dispensé du paiement des droits.
