Article 1092 of the French Code of civil procedure

The family affairs judge is seised by the submission of the application to the clerk’s office, which is equivalent to a pleading.

After hearing the minor under the conditions defined in Title IX bis of Book I or, in the absence of discernment, refusing to hear the minor under the conditions defined in Articles 338-4 and 338-5, he summons each of the spouses by simple letter sent at least fifteen days before the date he sets for their hearing. He shall notify the lawyer or lawyers.

Le juge aux affaires familiales est saisi par la remise au greffe de la requête, qui vaut conclusions.

Après avoir procédé à l’audition du mineur dans les conditions définies au titre IX bis du livre Ier ou, en l’absence de discernement, avoir refusé son audition dans les conditions définies aux articles 338-4 et 338-5, il convoque chacun des époux par lettre simple expédiée quinze jours au moins avant la date qu’il fixe pour leur audition. Il avise le ou les avocats.
