Article 1126-1 of the French Code of civil procedure

Where the application for divorce is based on the definitive alteration of the marriage bond under the conditions provided for in article 238, paragraph 2, of the Civil Code, the decision ruling on the principle of divorce may not be made before the expiry of the one-year period and subject to the last paragraph of article 238.

Lorsque la demande en divorce est fondée sur l’altération définitive du lien conjugal dans les conditions prévues à l’article 238, alinéa 2, du code civil, la décision statuant sur le principe du divorce ne peut intervenir avant l’expiration du délai d’un an et sous réserve du dernier alinéa de l’article 238.
