Article 1133 of the French Code of civil procedure

In the case provided for in the preceding article, the judge may not hear the spouses and simply examine the agreement with their lawyer.

If there are no difficulties, he shall homologate the agreement and pronounce the divorce.

Otherwise he may, without further formality, ask the spouses to present the petition again within one month, after amending the agreement; if this request is not complied with, the judge issues an order refusing to homologate the agreement.

The order mentions the time limit for appeal and the starting point of this time limit.

Dans le cas prévu à l’article précédent, le juge peut ne pas entendre les époux et se borner à examiner avec leur avocat la convention.

En l’absence de difficulté, il homologue la convention et prononce le divorce.

Sinon il peut, sans autres formes, demander aux époux de présenter à nouveau la requête dans le mois, après modification de la convention ; s’il n’est pas déféré à cette demande, le juge rend une ordonnance par laquelle il refuse d’homologuer la convention.

L’ordonnance mentionne le délai d’appel et le point de départ de ce délai.
