Article 1136-20 of the French Code of civil procedure

In the event of difficulties in carrying out the measure of wearing the mobile electronic anti-rapprochement device mentioned in the article 515-11-1 of the Civil Code, the matter may be referred to the Family Affairs Judge at any time under the conditions of the article 515-12 of the Civil Code, by either of the parties or by the public prosecutor, in order to modify all or part of the measures set out in the protection order.

The wearer of the bracelet and the Public Prosecutor may in particular request that the alert and pre-alert distances be revised, or that the prohibition on contact and the wearing of the bracelet be terminated, if the measure of wearing the mobile electronic anti-contact device results in a large number of alerts, due in particular to contact attributable both to the movements of the wearer and to those of the protected person, thereby excessively infringing the right to respect for the private and family life of the wearer of the bracelet.

They may also request that the protection order be modified in whole or in part.
They may also request that the measure to wear a mobile electronic anti-reconnection device be terminated if the device presents disadvantages for the wearer that have been ascertained by a doctor.

The applications provided for by this article shall be made, investigated and judged in the same way as the initial application.

En cas de difficultés dans l’exécution de la mesure de port du dispositif électronique mobile anti-rapprochement mentionné à l’article 515-11-1 du code civil, le juge aux affaires familiales peut être saisi à tout moment dans les conditions de l’article 515-12 du code civil, par l’une ou l’autre des parties ou par le procureur de la République, afin que soient modifiées en tout ou partie les mesures énoncées dans l’ordonnance de protection.

Le porteur du bracelet et le procureur de la République peuvent notamment demander que les distances d’alerte et de pré-alerte soient révisées, ou qu’il soit mis fin à l’interdiction de rapprochement et au port du bracelet, si la mesure de port du dispositif électronique mobile anti-rapprochement aboutit, du fait notamment de rapprochements imputables tant à ses déplacements qu’à ceux de la personne protégée, à un nombre important d’alertes, portant une atteinte excessive au droit au respect de la vie privée et familiale du porteur du bracelet.

Ils peuvent aussi demander à ce qu’il soit mis un terme à la mesure de port d’un dispositif électronique mobile anti-rapprochement si le dispositif présente pour le porteur du bracelet des inconvénients constatés par un médecin.

Les demandes prévues par le présent article sont formées, instruites et jugées selon les mêmes modalités que la requête initiale.
