Article 1138 of the French Code of civil procedure

Within fifteen days of the application, the clerk’s office summons the defendant to the hearing by registered letter with acknowledgement of receipt.

However, where the application states that the defendant’s address is the last known address, the clerk’s office invites the applicant to proceed by way of service.

The clerk’s office shall notify the applicant by any means of the place, day and time of the hearing.

The summons or summons shall mention, on pain of nullity, the provisions of articles 1139 to 1141.

Article 1138

Dans les quinze jours de la requête, le greffe convoque le défendeur à l’audience par lettre recommandée avec demande d’avis de réception.

Toutefois, lorsque la requête mentionne que l’adresse du défendeur est la dernière adresse connue, le greffe invite le requérant à procéder par voie de signification.

Le greffe avise par tous moyens l’auteur de la demande des lieu, jour et heure de l’audience.

L’assignation ou la convocation mentionne, à peine de nullité, les dispositions des articles 1139 à 1141.
