Article 117 of the French Code of civil procedure

The following constitute substantive irregularities affecting the validity of the deed:

Lack of capacity to bring legal proceedings;

Lack of authority of a party or a person appearing in the proceedings as the representative either of a legal person or of a person who is incapacitated;

The lack of capacity or authority of a person providing legal representation for a party.

Le défaut de capacité d’ester en justice ;

Le défaut de pouvoir d’une partie ou d’une personne figurant au procès comme représentant soit d’une personne morale, soit d’une personne atteinte d’une incapacité d’exercice ;

Le défaut de capacité ou de pouvoir d’une personne assurant la représentation d’une partie en justice.
