Article 118 of the French Code of civil procedure

Pleas of nullity based on failure to comply with the substantive rules relating to pleadings may be raised in any event, unless otherwise provided and except for the possibility that the judge may order those who have refrained, with dilatory intent, from raising them earlier to pay damages.

Les exceptions de nullité fondées sur l’inobservation des règles de fond relatives aux actes de procédure peuvent être proposées en tout état de cause, à moins qu’il en soit disposé autrement et sauf la possibilité pour le juge de condamner à des dommages-intérêts ceux qui se seraient abstenus, dans une intention dilatoire, de les soulever plus tôt.
