Article 1204 of the French Civil Code

An obligation may be incurred by promising the act of a third party.

The promisor is released from any obligation if the third party performs the promised act. If he does not, he may be ordered to pay damages.

Where the purpose of the porte-fort is to ratify an undertaking, the undertaking is validated retroactively to the date on which the porte-fort was entered into.

On peut se porter fort en promettant le fait d’un tiers.

Le promettant est libéré de toute obligation si le tiers accomplit le fait promis. Dans le cas contraire, il peut être condamné à des dommages et intérêts.

Lorsque le porte-fort a pour objet la ratification d’un engagement, celui-ci est rétroactivement validé à la date à laquelle le porte-fort a été souscrit.
