Article 1220-4 of the French Code of civil procedure

The judge shall, if he considers it appropriate, hear the persons listed in articles 430,494-1 and 494-10 du code civil. This hearing is a matter of right when it is requested by a person applying for protection.

In application of the provisions of the second paragraph of article 494-4 of the Civil Code, the judge shall establish the support or absence of legitimate opposition of the persons referred to in the second paragraph of Article 494-1 of the Civil Code after hearing them or in writing.

Le juge procède à l’audition, s’il l’estime opportun, des personnes énumérées aux articles 430,494-1 et 494-10 du code civil. Cette audition est de droit lorsqu’elle est sollicitée par une personne demandant à exercer la protection.

En application des dispositions du deuxième alinéa de l’article 494-4 du code civil, le juge constate l’adhésion ou l’absence d’opposition légitime des personnes visées au deuxième alinéa de l’article 494-1 du code civil après les avoir entendues ou par écrit.
