Article 124 of the French Civil Code

As soon as the extracts have been published, the request is forwarded, via the public prosecutor, to the court, which rules on the basis of the exhibits and documents produced and having regard to the conditions of the disappearance, as well as the circumstances that may explain the lack of news.

The court may order any additional measures of information and, if necessary, prescribe that an investigation be carried out in the presence of the public prosecutor, when the latter is not himself the petitioner, in any place where it deems it useful, and in particular in the district of domicile or in those of the last residences, if they are distinct.

Dès que les extraits en ont été publiés, la requête est transmise, par l’intermédiaire du procureur de la République, au tribunal qui statue d’après les pièces et documents produits et eu égard aux conditions de la disparition, ainsi qu’aux circonstances qui peuvent expliquer le défaut de nouvelles.

Le tribunal peut ordonner toute mesure d’information complémentaire et prescrire, s’il y a lieu, qu’une enquête soit faite contradictoirement avec le procureur de la République, quand celui-ci n’est pas lui-même requérant, dans tout lieu où il le jugera utile, et notamment dans l’arrondissement du domicile ou dans ceux des dernières résidences, s’ils sont distincts.
