Article 125 of the French Civil Code

The application initiating proceedings may be made as early as one year before the expiry of the time limits provided for in paragraphs 1 and 2 of Article 122. The declaration of absence is made at least one year after publication of the extracts from this application. It establishes that the person presumed absent has not reappeared during the periods referred to in article 122.

La requête introductive d’instance peut être présentée dès l’année précédant l’expiration des délais prévus aux alinéas 1 et 2 de l’article 122. Le jugement déclaratif d’absence est rendu un an au moins après la publication des extraits de cette requête. Il constate que la personne présumée absente n’a pas reparu au cours des délais visés à l’article 122.
