Article 1258-1 of the French Code of civil procedure

For the implementation of the future protection mandate established pursuant to the third paragraph of Article 477 of the Civil Code, the mandatary shall appear in person at the registry of the judicial court in whose jurisdiction the beneficiary of the mandate resides, accompanied by the latter, unless it is established, by medical certificate, that his presence at the court is incompatible with his state of health.

The mandatary shall present to the court clerk:

1° The authentic copy of the mandate, signed by the mandator and the mandatary;

2° A death certificate of the mandator or a medical certificate no more than two months old, from a doctor on the list mentioned in article 431 of the Civil Code and establishing that the principal is in one of the situations provided for in article 425 of the same code ;

3° A medical certificate no more than two months old, issued by a doctor on the list referred to in article 431 of the Civil Code and establishing that the principal’s adult child designated as the beneficiary of the mandate is in one of the situations provided for in article 425 of the same code;

4° An identity document relating respectively to the mandatary and the beneficiary of the mandate;

5° Proof of the habitual residence of the beneficiary of the mandate.

Article 1258-1

Pour la mise en œuvre du mandat de protection future établi en application du troisième alinéa de l’article 477 du code civil, le mandataire se présente en personne au greffe du tribunal judiciaire dans le ressort duquel réside le bénéficiaire du mandat, accompagné de ce dernier, sauf s’il est établi, par certificat médical, que sa présence au tribunal est incompatible avec son état de santé.

Le mandataire présente au greffier :

1° La copie authentique du mandat, signé du mandant et du mandataire ;

2° Un certificat de décès du mandant ou un certificat médical datant de deux mois au plus, émanant d’un médecin inscrit sur la liste mentionnée à l’article 431 du code civil et établissant que le mandant se trouve dans l’une des situations prévues à l’article 425 du même code ;

3° Un certificat médical datant de deux mois au plus, émanant d’un médecin inscrit sur la liste mentionnée à l’article 431 du code civil et établissant que l’enfant majeur du mandant désigné comme le bénéficiaire du mandat se trouve dans l’une des situations prévues à l’article 425 du même code ;

4° Une pièce d’identité relative respectivement au mandataire et au bénéficiaire du mandat ;

5° Un justificatif de la résidence habituelle du bénéficiaire du mandat.
