Article 1262-2 of the French Code of civil procedure

The guardianship judge is seised by a request from the public prosecutor to which is attached the report mentioned in Article 1262.

The judge gathers all useful information. The court clerk shall summon to the hearing, by registered letter with acknowledgement of receipt, the person receiving the benefits, as well as those whose hearing the judge considers useful.

The file may be consulted at the clerk’s office until the judge has made his decision by the person receiving the benefits, at his written request and without any restriction other than the requirements of the service.

Le juge des tutelles est saisi par requête du procureur de la République à laquelle est joint le rapport mentionné à l’article 1262.


Le juge recueille toutes informations utiles. Le greffier convoque à l’audience, par lettre recommandée avec demande d’avis de réception, la personne qui perçoit les prestations, ainsi que celles dont le juge estime l’audition utile.


Le dossier peut être consulté au greffe jusqu’à ce que le juge ait statué par la personne qui perçoit les prestations, sur demande écrite de sa part et sans autre restriction que les nécessités du service.
