Article 1271 of the French Code of civil procedure

The judicial sale of real estate and businesses belonging to minors under guardianship or to adults under guardianship may only be ordered on the basis of a deliberation by the family council stating the nature of the property and its approximate value.

This deliberation is not necessary if the property belongs at the same time to capable adults and if the sale is pursued by them. In this case, it is carried out in accordance with the rules laid down for judicial divisions.

La vente judiciaire des immeubles et des fonds de commerce appartenant à des mineurs en tutelle ou à des majeurs en tutelle ne peut être ordonnée qu’au vu d’une délibération du conseil de famille énonçant la nature des biens et leur valeur approximative.

Cette délibération n’est pas nécessaire si les biens appartiennent en même temps à des majeurs capables et si la vente est poursuivie par eux. Il est alors procédé conformément aux règles prévues pour les partages judiciaires.
