Article 1272 of the French Code of civil procedure

At the request of the guardian or subrogated guardian, the bids are received either by a notary appointed for this purpose by the judicial court, or at the auction hearing by a judge appointed by that court.

The competent court is that within whose jurisdiction the person under guardianship resides.

If the property is located in several arrondissements, the court may appoint a notary in each of these arrondissements and give letters rogatory to each of the courts where the property is located.

Sur requête du tuteur ou du subrogé tuteur, les enchères sont reçues soit par un notaire commis à cet effet par le tribunal judiciaire, soit à l’audience des criées par un juge désigné par ce tribunal.

Le tribunal compétent est celui dans le ressort duquel demeure la personne en tutelle.

Si les biens sont situés dans plusieurs arrondissements, le tribunal peut commettre un notaire dans chacun de ces arrondissements et donner commission rogatoire à chacun des tribunaux de la situation de ces biens.
