Article 1273 of the French Code of civil procedure

The court shall determine the upset price for each of the assets to be sold and the essential terms of the sale. It may specify that in the absence of bids reaching this reserve price, the sale may be made at a lower reserve price which it shall fix.

The court may, if the value or consistence of the property justifies it, arrange for its total or partial appraisal.

Le tribunal détermine la mise à prix de chacun des biens à vendre et les conditions essentielles de la vente. Il peut préciser qu’à défaut d’enchères atteignant cette mise à prix, la vente pourra se faire sur une mise à prix inférieure qu’il fixe.

Le tribunal peut, si la valeur ou la consistance des biens le justifie, faire procéder à leur estimation totale ou partielle.
