Article 1275 of the French Code of civil procedure

The appointed notary or lawyer draws up a schedule of charges. If the sale takes place at the auction hearing, this schedule of conditions is filed at the court registry.

The schedule of conditions indicates the judgment ordering the sale, designates the property to be sold and mentions the upset price and the conditions of the sale. Where the sale relates to a business, the specification sheet specifies the nature and location of both the business and the various elements that make it up, as well as the obligations that will be imposed on the purchaser, particularly with regard to the goods that furnish the business.

Le notaire commis ou l’avocat établit un cahier des charges. Si la vente a lieu à l’audience des criées, ce cahier est déposé au greffe du tribunal.

Le cahier des charges indique le jugement qui a ordonné la vente, désigne les biens à vendre et mentionne la mise à prix et les conditions de la vente. Lorsque la vente porte sur un fonds de commerce, le cahier des charges spécifie la nature et la situation tant du fonds que des divers éléments qui le composent, ainsi que les obligations qui seront imposées à l’acquéreur, notamment quant aux marchandises qui garnissent le fonds.
