Article 1281-14 of the French Code of civil procedure

The creditor who pursues the auction sale of the property pursuant to Article 2465 of the Civil Code notifies the requisition deed provided for in this article by bailiff to the principal debtor, the third party purchaser and the other creditors holding a registration on the property. This deed shall contain, under penalty of nullity, the constitution of the applicant’s lawyer, the higher bid and the offer of security.

The deed of requisition of sale by auction shall include the attestation by the creditor’s lawyer that he has been given, an irrevocable bank guarantee or any equivalent guarantee, precisely stated.

Le créancier qui poursuit la vente aux enchères de l’immeuble en application de l’article 2465 du code civil notifie l’acte de réquisition prévu à cet article par acte d’huissier de justice au débiteur principal, au tiers acquéreur ainsi qu’aux autres créanciers titulaires d’une inscription sur l’immeuble. Cet acte contient, à peine de nullité, la constitution de l’avocat du requérant, la surenchère et l’offre de caution.

L’acte de réquisition de vente aux enchères comporte l’attestation par l’avocat du créancier qu’il s’est fait remettre, une caution bancaire irrévocable ou toute garantie équivalente, précisément énoncée.
