Article 1281-3 of the French Code of civil procedure

The court clerk’s office shall notify by simple letter a copy of the order to the person in charge of the distribution and, if consignment has been ordered, to the Caisse des dépôts et consignations.

The person in charge of the distribution shall notify the creditors, by registered letter with acknowledgement of receipt, that they must, within a period of one month, send him a statement including a breakdown of the sums claimed in principal, interest and other accessories. Where applicable, this statement shall mention any liens and securities attached to the claim. The supporting documents shall be attached to the declaration.

If the declaration is not made within the period mentioned in the preceding paragraph, the creditor shall forfeit the right to participate in the distribution.

Le greffe notifie par lettre simple une copie de l’ordonnance à la personne chargée de la distribution et, si la consignation a été ordonnée, à la Caisse des dépôts et consignations.

La personne chargée de la distribution avise les créanciers, par lettre recommandée avec demande d’avis de réception, qu’ils doivent, dans un délai d’un mois, lui adresser une déclaration comportant un décompte des sommes réclamées en principal, intérêts et autres accessoires. Le cas échéant, cette déclaration mentionne les privilèges et sûretés attachés à la créance. Les documents justificatifs sont joints à la déclaration.

A défaut de déclaration dans le délai mentionné à l’alinéa qui précède, le créancier est déchu du droit de participer à la distribution.
