Article 131 sexies of the French General Tax Code

I. – Income from shares, corporate units or profit shares distributed by French companies, as well as income mentioned in article 118 which benefit international organisations, foreign sovereign States or the central banks of these States, are exempt from the withholding taxes provided for in 1 and 2 of l’article 119 bis et du prélèvement prévu au III de article 125 A.

These investments must not constitute a direct investment within the meaning of the loi n° 66-1008 du 28 décembre 1966 modified law relating to financial relations with foreign countries and the regulatory texts issued for its application. The securities must be in registered form or deposited with a credit institution established in France.

II. – With the approval of the Minister for the Economy and Finance, the withholding taxes provided for in 1 and 2 of Article 119 bis and the levy provided for in III of Article 125 A may be reduced or waived in respect of:

The products mentioned in I which benefit foreign public institutions;

The products mentioned in articles 124 and 1678 bis and those relating to investments constituting direct investments in France within the meaning of I which benefit international organisations, foreign sovereign States, the central banks of these States or foreign public financial institutions.

Article 131 sexies

I. – Les produits d’actions, de parts sociales ou de parts bénéficiaires distribués par des sociétés françaises, ainsi que les produits mentionnés à l’article 118 qui bénéficient à des organisations internationales, à des Etats souverains étrangers ou aux banques centrales de ces Etats, sont exonérés des retenues à la source prévues aux 1 et 2 de l’article 119 bis et du prélèvement prévu au III de l’article 125 A.

Ces placements ne doivent pas constituer un investissement direct au sens de la loi n° 66-1008 du 28 décembre 1966 modifiée relative aux relations financières avec l’étranger et des textes réglementaires pris pour son application. Les titres doivent revêtir la forme nominative ou être déposés auprès d’un établissement de crédit établi en France.

II. – Sur agrément du ministre de l’économie et des finances, les retenues à la source prévues aux 1 et 2 de l’article 119 bis et le prélèvement prévu au III de l’article 125 A peuvent être réduits ou supprimés en ce qui concerne :

Les produits mentionnés au I qui bénéficient à des institutions publiques étrangères ;

Les produits mentionnés aux articles 124 et 1678 bis et ceux afférents à des placements constituant des investissements directs en France au sens du I qui bénéficient à des organisations internationales, à des Etats souverains étrangers, aux banques centrales de ces Etats ou à des institutions financières publiques étrangères.
