Article 1333 of the French Civil Code

Novation by change of creditor requires the debtor’s consent. The latter may, in advance, agree to the new creditor being designated by the first creditor.

La novation par changement de créancier requiert le consentement du débiteur. Celui-ci peut, par avance, accepter que le nouveau créancier soit désigné par le premier.

La novation est opposable aux tiers à la date de l’acte. En cas de contestation de la date de la novation, la preuve en incombe au nouveau créancier, qui peut l’apporter par tout moyen.
