Article 1334 of the French Code of civil procedure

The declaration of acceptance up to the net assets made at the clerk’s office of the judicial court or before a notary shall indicate the heir’s surname, first names and profession, his election of domicile and the capacity by virtue of which he is called to the succession.

The notary with whom the declaration is made informs the heir of the obligation to publicise provided for in the third paragraph of Article 1335. Within one month of the declaration, the notary sends a copy to the judicial court within whose jurisdiction the succession was opened.

The registry enters the declaration in a register kept for this purpose and gives a receipt to the declarant or the notary. It informs the heir of the publicity obligation provided for in the third paragraph of article 1335.

Co-heirs, successor creditors and legatees may, on proof of their title, consult the part of the register relating to the succession in question.

Article 1334

La déclaration d’acceptation à concurrence de l’actif net faite au greffe du tribunal judiciaire ou devant notaire indique les nom, prénoms et profession de l’héritier, son élection de domicile ainsi que la qualité en vertu de laquelle il est appelé à la succession.

Le notaire auprès de qui la déclaration est faite informe l’héritier de l’obligation de publicité prévue au troisième alinéa de l’article 1335. Dans le mois de la déclaration, le notaire en adresse copie au tribunal judiciaire dans le ressort duquel la succession s’est ouverte.

Le greffe inscrit la déclaration dans un registre tenu à cet effet et en donne récépissé au déclarant ou au notaire. Il informe l’héritier de l’obligation de publicité prévue au troisième alinéa de l’article 1335.

Les cohéritiers, les créanciers successoraux et les légataires peuvent, sur justification de leur titre, consulter la partie du registre relative à la succession en cause.
