Article 1345-1 of the French Civil Code

If the obstruction has not ended within two months of the formal notice, the debtor may, where the obligation relates to a sum of money, consign it to the Caisse des dépôts et consignations or, where the obligation relates to the delivery of an item, sequester it with a professional custodian.

If sequestering the item is impossible or too costly, the judge may authorise its sale out of court or at public auction. After deduction of the costs of the sale, the price is consigned to the Caisse des dépôts et consignations.

The consignment or sequestration discharges the debtor from the date of notification to the creditor.

Si l’obstruction n’a pas pris fin dans les deux mois de la mise en demeure, le débiteur peut, lorsque l’obligation porte sur une somme d’argent, la consigner à la Caisse des dépôts et consignations ou, lorsque l’obligation porte sur la livraison d’une chose, séquestrer celle-ci auprès d’un gardien professionnel.

Si le séquestre de la chose est impossible ou trop onéreux, le juge peut en autoriser la vente amiable ou aux enchères publiques. Déduction faite des frais de la vente, le prix en est consigné à la Caisse des dépôts et consignations.

La consignation ou le séquestre libère le débiteur à compter de leur notification au créancier.
