Article 1367 of the French Code of civil procedure

The formal notice provided for in article 841-1 of the Civil Code is served on the defaulting heir. If the heir or his representative fails to appear by the date set in the formal notice, the notary draws up a report and forwards it to the judge appointed to designate a representative for the defaulting heir.

Article 1367

La mise en demeure prévue à l’article 841-1 du code civil est signifiée à l’héritier défaillant. Elle mentionne la date prévue pour réaliser les opérations de partage.

A défaut de présentation de l’héritier ou de son mandataire à la date fixée dans la mise en demeure, le notaire dresse un procès-verbal et le transmet au juge commis afin que soit désigné un représentant à l’héritier défaillant.
