Article 1384 G of the French General Tax Code

New constructions allocated to the main dwelling resulting from demolition operations and reconstitution of the supply of social rental housing demolished under the conditions provided for in articles 6 and 9-1 of law n° 2003-710 of 1st August 2003 on the guidelines and programming for towns and urban renewal and provided for under the agreements mentioned in article 10-3 of the same law may not benefit from the exemptions provided for in articles 1384 to 1384 F of this code when the buildings they replace, within the perimeter of the same priority district defined in the aforementioned agreement, have benefited from one of these exemptions and if the total number of social rental housing units, within the meaning of article L. 302-5 of the French Construction and Housing Code, represents at least 50% of the main residences in the municipality in which these buildings are located.

The provisions of the first paragraph apply to operations to reconstitute demolished housing approved from 1 January 2017.

Article 1384 G

Les constructions neuves affectées à l’habitation principale issues des opérations de démolition et de reconstitution de l’offre de logements locatifs sociaux démolis dans les conditions prévues aux articles 6 et 9-1 de la loi n° 2003-710 du 1er août 2003 d’orientation et de programmation pour la ville et la rénovation urbaine et prévues dans le cadre des conventions mentionnées à l’article 10-3 de la même loi ne peuvent bénéficier des exonérations prévues aux articles 1384 à 1384 F du présent code lorsque les immeubles auxquels elles se substituent, au sein du périmètre du même quartier prioritaire défini dans la convention susmentionnée, ont bénéficié d’une de ces exonérations et si le nombre total de logements locatifs sociaux, au sens de l’article L. 302-5 du code de la construction et de l’habitation, représente sur le territoire de la commune du lieu de situation de ces constructions au moins 50 % des résidences principales.

Les dispositions du premier alinéa s’appliquent aux opérations de reconstitution de l’offre démolie agréées à compter du 1er janvier 2017.
