Article 149-2 of the French Code of Criminal Procedure

The First President of the Court of Appeal, on receipt of a petition within six months of the decision to dismiss the case, acquit or acquit having become final, shall give a reasoned decision.

The proceedings shall be held in open court, unless the petitioner objects. At his request, the claimant is heard in person or through his counsel.

Le premier président de la cour d’appel, saisi par voie de requête dans le délai de six mois de la décision de non-lieu, de relaxe ou d’acquittement devenue définitive, statue par une décision motivée.

Les débats ont lieu en audience publique, sauf opposition du requérant. A sa demande, celui-ci est entendu personnellement ou par l’intermédiaire de son conseil.
