Article 1521 of the French Civil Code

Where it has been stipulated that the spouse or his or her heirs will only have a certain share in the community, such as one-third or one-quarter, the spouse thus reduced or his or her heirs only bear the community debts in proportion to the share they take in the assets.

The agreement is void if it obliges the spouse so reduced or his heirs to bear a greater share, or if it exempts them from bearing a share in the debts equal to the share they take in the assets.

Lorsqu’il a été stipulé que l’époux ou ses héritiers n’auront qu’une certaine part dans la communauté, comme le tiers ou le quart, l’époux ainsi réduit ou ses héritiers ne supportent les dettes de la communauté que proportionnellement à la part qu’ils prennent dans l’actif.

La convention est nulle si elle oblige l’époux ainsi réduit ou ses héritiers à supporter une plus forte part, ou si elle les dispense de supporter une part dans les dettes égale à celle qu’ils prennent dans l’actif.
