Article 1557 of the French Code of civil procedure

The application for homologation of the parties’ agreement drawn up in accordance with Article 1555 shall be submitted to the judge by application of the most diligent party or of all the parties.

On pain of inadmissibility, the application shall be accompanied by the participatory procedure agreement.

Where the agreement concerns a minor capable of discernment, in particular where it relates to the terms and conditions of the exercise of parental authority, the application shall mention the conditions under which the minor has been informed of his or her right to be heard by the judge or the person designated by him or her and to be assisted by a lawyer.

La demande tendant à l’homologation de l’accord des parties établi conformément à l’article 1555 est présentée au juge par requête de la partie la plus diligente ou de l’ensemble des parties.


A peine d’irrecevabilité, la requête est accompagnée de la convention de procédure participative.


Lorsque l’accord concerne un mineur capable de discernement, notamment lorsqu’il porte sur les modalités de l’exercice de l’autorité parentale, la requête mentionne les conditions dans lesquelles le mineur a été informé de son droit à être entendu par le juge ou la personne désignée par lui et à être assisté par un avocat.
