Article 1651 L of the French General Tax Code

Where increases based on the same grounds are notified to companies that are members of a group within the meaning of Article 223 A or article 223 A bis, any taxpayer may request that the matter be referred to the national commission referred to in article 1651 H if at least one of these companies meets the conditions set out in 2 of this article. The national commission then has jurisdiction over all disagreements persisting on the reassessments notified to this taxpayer and falling within its remit.

Taxpayers whose tax bases have been increased under d of Article 111 may request a referral to the national commission referred to in Article 1651 H if the paying company falls under the latter.

Lorsque des rehaussements fondés sur les mêmes motifs sont notifiés à des sociétés membres d’un groupe au sens de l’article 223 A ou de l’article 223 A bis, chaque contribuable peut demander la saisine de la commission nationale mentionnée à l’article 1651 H si au moins l’une de ces sociétés réunit les conditions fixées au 2 de cet article. La commission nationale est alors compétente sur l’ensemble des désaccords persistant sur les rehaussements notifiés à ce contribuable et relevant de ses attributions.


Les contribuables dont les bases d’imposition ont été rehaussées en vertu du d de l’article 111 peuvent demander la saisine de la commission nationale visée à l’article 1651 H si l’entreprise versante relève de cette dernière.
