Article 1687 of the French General Tax Code

Landlords and, in their place, the main tenants who have not, one month before the term set by the lease or by verbal agreements, given notice to the public accountant responsible for collecting direct taxes of their tenants’ move, are liable for the sums owed by them for business property tax.

In the event that this term is brought forward, as in the case of a stealth move, the owners and, in their place, the principal tenants become liable for their tenants’ tax, if they have not, within three months, given notice of the move to the public accountant.

The portion of the tax left to the owners or principal tenants by the first and second paragraphs includes only the fraction relating to the practice of the profession during the previous and current month.

Les propriétaires et, à leur place, les principaux locataires qui n’ont pas, un mois avant le terme fixé par le bail ou par les conventions verbales, donné avis au comptable public chargé du recouvrement des impôts directs du déménagement de leurs locataires, sont responsables des sommes dues par ceux-ci pour la cotisation foncière des entreprises.

Dans le cas où ce terme est devancé, comme dans le cas de déménagement furtif, les propriétaires et, à leur place, les principaux locataires deviennent responsables de la taxe de leurs locataires, s’ils n’ont pas, dans les trois mois, donné avis du déménagement au comptable public.

La part de la taxe laissée à la charge des propriétaires ou principaux locataires par les premier et deuxième alinéas comprend seulement la fraction afférente à l’exercice de la profession au cours du mois précédent et du mois courant.
