Article 1716 of the French Civil Code

When there is a dispute about the price of a verbal lease whose execution has begun, and there is no receipt, the owner will be believed on his oath, if the tenant does not prefer to ask for an expert valuation; in which case the costs of the valuation remain at his expense, if the valuation exceeds the price he has declared.

Lorsqu’il y aura contestation sur le prix du bail verbal dont l’exécution a commencé, et qu’il n’existera point de quittance, le propriétaire en sera cru sur son serment, si mieux n’aime le locataire demander l’estimation par experts ; auquel cas les frais de l’expertise restent à sa charge, si l’estimation excède le prix qu’il a déclaré.
