Article 1813 of the French General Tax Code

a. A fine of €6,000 shall be imposed on anyone who, not being the holder of the exemption provided for in Article 311 bis, has, in a professional capacity, used a mobile distillation apparatus;

b. Any infringement of the provisions of article 306 is punishable by the same penalty;

c. In the event of a repeat offence under a and b, a term of imprisonment of one year may also be imposed.

Any person who, having been convicted of an offence provided for by one of the legislations whose purpose is the prevention, repression or cure of alcoholism or drunkenness, or by the legislation on the police of public houses, has, within five years of the date on which this conviction became final, committed a new offence falling under the application of a and b, shall be considered to be in a state of legal recidivism.

Article 1813

a. Est puni d’une amende de 6 000 €, quiconque, n’étant pas titulaire de la dérogation prévue à l’article 311 bis, a, à titre professionnel, utilisé un appareil de distillation ambulant ;

b. Toute infraction aux dispositions de l’article 306 est punie de la même peine ;

c. En cas de récidive des infractions prévues aux a et b, une peine d’emprisonnement d’un an peut en outre être prononcée.

Est considéré comme en état de récidive légale quiconque ayant été condamné pour un délit prévu par l’une des législations ayant pour objet la prévention, la répression ou la cure de l’alcoolisme ou de l’ivresse, ou par la législation sur la police des débits de boissons, a, dans les cinq ans qui suivent la date à laquelle cette condamnation est devenue définitive, commis un nouveau délit tombant sous l’application des a et b.
