Article 1840 P of the French General Tax Code

(1) Those who knowingly use, sell or attempt to sell mobile stamps that have already been used shall be prosecuted before the criminal court and punished by a fine of €3,750. In the event of a repeat offence, the penalty shall be one month’s imprisonment and the fine shall be doubled.

The provisions of this article shall apply in all cases where a tax, duty or charge of any kind collected by the tax authorities is paid by means of the affixing of mobile stamps.

2. The provisions of the first paragraph of 1 shall apply to those who, with fraudulent intent, have altered, used, sold or attempted to sell stamped papers that have already been used.

1. Ceux qui ont sciemment employé, vendu ou tenté de vendre des timbres mobiles ayant déjà servi, sont poursuivis devant le tribunal correctionnel et punis d’une amende de 3 750 €. En cas de récidive, la peine est d’un emprisonnement d’un mois et l’amende est doublée.

Les dispositions du présent article sont applicables dans tous les cas où un impôt, une taxe ou un droit quelconque recouvré par l’administration fiscale est acquitté au moyen de l’apposition de timbres mobiles.

2. Les dispositions du premier alinéa du 1 sont applicables à ceux qui, dans une intention frauduleuse, ont altéré, employé, vendu ou tenté de vendre des papiers timbrés ayant déjà servi.
