Article 2045 of the French Civil Code

To transact, you must have the capacity to dispose of the items included in the transaction.

The guardian may only transact for the minor or adult under guardianship in accordance with Article 467 under the heading “De la minorité, de la tutelle et de l’émancipation”; and he may only compromise with the minor who has become of age, on the tutorship account, in accordance with Article 472 au même titre.

Public establishments of the State may only compromise with the express authorisation of the Prime Minister.

Pour transiger, il faut avoir la capacité de disposer des objets compris dans la transaction.

Le tuteur ne peut transiger pour le mineur ou le majeur en tutelle que conformément à l’article 467 au titre ” De la minorité, de la tutelle et de l’émancipation ” ; et il ne peut transiger avec le mineur devenu majeur, sur le compte de tutelle, que conformément à l’article 472 au même titre.

Les établissements publics de l’Etat ne peuvent transiger qu’avec l’autorisation expresse du Premier ministre.
