Article 211-53 of the French Cinema and Moving Image Code

When, for the production of an audiovisual work, a production company has received financial support for the production and preparation of audiovisual works, it may apply for production approval for this work. In this case, production approval may only be granted if the following conditions are met:
1° The audiovisual work must not have been broadcast for the first time on a television service or made available to the public for the first time on an on-demand audiovisual media service in France;
2° The production company must have waived its entitlement to financial support for the production and preparation of audiovisual works before the cinematographic exhibition licence was issued.

Article 211-53

Lorsque, pour la production d’une œuvre audiovisuelle, une entreprise de production a bénéficié des aides financières à la production et à la préparation des œuvres audiovisuelles, elle a la faculté de demander l’agrément de production au titre de cette œuvre. Dans ce cas, l’agrément de production ne peut être délivré que si les conditions suivantes sont remplies :
1° L’œuvre audiovisuelle ne doit pas avoir fait l’objet d’une première diffusion sur un service de télévision ou d’une première mise à disposition du public sur un service de médias audiovisuels à la demande, en France ;
2° L’entreprise de production doit avoir renoncé au bénéfice des aides financières à la production et à la préparation des œuvres audiovisuelles avant la délivrance du visa d’exploitation cinématographique.
