Where the assignee does not have free disposal of the sum assigned, the fruits and interest produced by it increase the basis of the guarantee, unless otherwise agreed.

Where the assignee has free disposal of the sum assigned, interest may be agreed for the benefit of the assignor.

Lorsque le cessionnaire n’a pas la libre disposition de la somme cédée, les fruits et intérêts produits par celle-ci accroissent l’assiette de la garantie, sauf clause contraire.

Lorsque le cessionnaire a la libre disposition de la somme cédée, il peut être convenu d’un intérêt au profit du cédant.
