The approval provided for in article 238 bis HE is issued by the President of the Centre national du cinéma et de l’image animée to original French-language works, as defined in the decree issued in application of law no. 86-1067 of 30 September 1986 relating to freedom of communication, of the nationality of a State party to the European Convention on Cinematographic Co-production done at Strasbourg on 2 October 1992 and eligible for financial aid for production from the Centre national du cinéma et de l’image animée, excluding:
Works appearing on the list provided for in l’article L. 311-2 of the Code du cinéma et de l’image animée;
Cinematographic or audiovisual works usable for advertising purposes;
News programmes, current affairs debates and sports or variety programmes;
Any audiovisual document or programme containing only incidental elements of original creation.
However, within the limit of 20% of the annual funding referred to in Article 238 bis HE, the approval provided for in the same Article may be granted to co-production works made in a language of the country of the majority co-producer established in a State party to the convention referred to in the first paragraph of this Article or to an intergovernmental co-production agreement to which France is a party.
