Article 2392 of the French Civil Code

Legal mortgages are general or special.

The creditor benefiting from a general mortgage may register his right on all immovables currently belonging to his debtor. He may make additional registrations on immovable property that has subsequently become part of his debtor’s estate.

The creditor benefiting from a general mortgage may register his right on all immovable property currently owned by his debtor.
The creditor benefiting from a special mortgage may only register his right on the immovable to which it relates.

Les hypothèques légales sont générales ou spéciales.


Le créancier bénéficiaire d’une hypothèque générale peut inscrire son droit sur tous les immeubles appartenant actuellement à son débiteur. Il peut prendre des inscriptions complémentaires sur les immeubles entrés, par la suite, dans le patrimoine de son débiteur.


Le créancier bénéficiaire d’une hypothèque spéciale ne peut inscrire son droit que sur l’immeuble sur lequel elle porte.
