Article 2393 of the French Civil Code

Other than those provided for by special laws, the claims to which a general legal mortgage is attached are:

1° Those of one of the spouses against the other;

2° Those of minors or adults under guardianship against the legal administrator or guardian;

4° those of the legatee, on the immovable property of the succession, by virtue of article 1017;

> (Repealed)
5° funeral expenses;

6° those which have been the subject of a judgement, against the convicted debtor;

> 7° those of the Treasury, against the convicted debtor;

7° Those of the Treasury, in accordance with the conditions set out in the Book of Tax Procedures;

8° Those of the social security funds, under the conditions laid down by the Social Security Code.

Outre celles prévues par des lois spéciales, les créances auxquelles une hypothèque légale générale est attachée sont :


1° Celles de l’un des époux contre l’autre ;


2° Celles des mineurs ou des majeurs en tutelle contre l’administrateur légal ou le tuteur ;


3° (Abrogé) ;


4° Celles du légataire, sur les biens immeubles de la succession, en vertu de l’article 1017 ;


5° Celles des frais funéraires ;


6° Celles ayant fait l’objet d’un jugement, contre le débiteur condamné ;


7° Celles du Trésor public, dans les conditions fixées par le livre des procédures fiscales ;


8° Celles des caisses de sécurité sociale, dans les conditions fixées par le code de la sécurité sociale.
