Article 2436 of the French Civil Code

In either case, those requesting the cancellation shall file with the service responsible for land registration the authenticated copy of the deed of consent, or that of the judgment.

No supporting document is required in support of the authenticated copy of the deed as regards the statements establishing the status, capacity and quality of the parties, where these statements are certified as accurate in the deed by the notary or the administrative authority.

Removal of the registration may be requested by filing an authenticated copy of the notarial deed with the service responsible for land registration, certifying that the creditor has, at the request of the debtor, given his agreement to this removal; the control carried out by this service is limited to the formal regularity of the deed to the exclusion of its validity on the merits.

Dans l’un et l’autre cas, ceux qui requièrent la radiation déposent au service chargé de la publicité foncière l’expédition de l’acte authentique portant consentement, ou celle du jugement.

Aucune pièce justificative n’est exigée à l’appui de l’expédition de l’acte authentique en ce qui concerne les énonciations établissant l’état, la capacité et la qualité des parties, lorsque ces énonciations sont certifiées exactes dans l’acte par le notaire ou l’autorité administrative.

La radiation de l’inscription peut être requise par le dépôt au service chargé de la publicité foncière d’une copie authentique de l’acte notarié certifiant que le créancier a, à la demande du débiteur, donné son accord à cette radiation ; le contrôle opéré par ce service se limite à la régularité formelle de l’acte à l’exclusion de sa validité au fond.
