Article 2440 of the French Civil Code

When the legal mortgage has been registered pursuant to article 2394, and unless there is an express clause in the marriage contract prohibiting it, the spouse who is the beneficiary of the registration may release it in whole or in part.

The same applies to a legal mortgage, or possibly a judicial mortgage, guaranteeing maintenance allocated or likely to be allocated to a spouse, for himself or herself or for his or her children.

If the spouse benefiting from the registration, by refusing to reduce his or her mortgage or to release it, prevents the other spouse from making a mortgage or a disposal that would be required in the interests of the family or, if he or she is unable to express his or her will, the judges may authorise such reduction or release on the conditions they deem necessary to safeguard the rights of the spouse concerned. They have the same powers where the marriage contract contains the clause referred to in the first paragraph.

Quand l’hypothèque légale a été inscrite par application de l’article 2394, et sauf clause expresse du contrat de mariage l’interdisant, l’époux bénéficiaire de l’inscription peut en donner mainlevée totale ou partielle.

Il en est ainsi même en ce qui concerne l’hypothèque légale, ou éventuellement l’hypothèque judiciaire, garantissant la pension alimentaire allouée ou susceptible d’être allouée à un époux, pour lui ou pour ses enfants.

Si l’époux bénéficiaire de l’inscription, en refusant de réduire son hypothèque ou d’en donner mainlevée, empêche l’autre époux de faire une constitution d’hypothèque ou une aliénation qu’exigerait l’intérêt de la famille ou, s’il est hors d’état de manifester sa volonté, les juges pourront autoriser cette réduction ou cette mainlevée aux conditions qu’ils estimeront nécessaires à la sauvegarde des droits de l’époux intéressé. Ils ont les mêmes pouvoirs lorsque le contrat de mariage comporte la clause visée au premier alinéa.
