Article 249 of the French Code of Criminal Procedure

The assessors are chosen either from among the councillors of the court of appeal, or from among the presidents, vice-presidents, or judges within the jurisdiction of the court of appeal.

The first president of the court of appeal may designate one of the assessors, when the assize court rules at first instance, from among the magistrates exercising a temporary judicial function or, when it rules at first instance or on appeal, from among the honorary magistrates exercising judicial functions under the conditions provided for in the Section II of Chapter Va of Ordinance No. 58-1270 of 22 December 1958 establishing an organic law on the status of the judiciary.

Les assesseurs sont choisis soit parmi les conseillers de la cour d’appel, soit parmi les présidents, vice-présidents, ou juges du ressort de la cour d’appel.

Le premier président de la cour d’appel peut désigner un des assesseurs, lorsque la cour d’assises statue en premier ressort, parmi les magistrats exerçant à titre temporaire ou, lorsqu’elle statue en premier ressort ou en appel, parmi les magistrats honoraires exerçant des fonctions juridictionnelles dans les conditions prévues à la section II du chapitre V bis de l’ordonnance n° 58-1270 du 22 décembre 1958 portant loi organique relative au statut de la magistrature.
