Article 265 of the French Civil Code

Divorce has no effect on matrimonial benefits that take effect during the marriage and on gifts of present property whatever their form.

Divorce automatically revokes matrimonial benefits that take effect only on dissolution of the matrimonial property regime or on the death of one of the spouses and dispositions mortis causa, granted by one spouse to his or her spouse by marriage contract or during the union, unless the spouse who granted them wishes otherwise. This will is recorded in the agreement signed by the spouses and countersigned by the lawyers or by the judge when the divorce is pronounced and renders the benefit or provision maintained irrevocable.

However, if the marriage contract so provides, the spouses may always take back the property they have contributed to the community.

Le divorce est sans incidence sur les avantages matrimoniaux qui prennent effet au cours du mariage et sur les donations de biens présents quelle que soit leur forme.

Le divorce emporte révocation de plein droit des avantages matrimoniaux qui ne prennent effet qu’à la dissolution du régime matrimonial ou au décès de l’un des époux et des dispositions à cause de mort, accordés par un époux envers son conjoint par contrat de mariage ou pendant l’union, sauf volonté contraire de l’époux qui les a consentis. Cette volonté est constatée dans la convention signée par les époux et contresignée par les avocats ou par le juge au moment du prononcé du divorce et rend irrévocables l’avantage ou la disposition maintenus.

Toutefois, si le contrat de mariage le prévoit, les époux pourront toujours reprendre les biens qu’ils auront apportés à la communauté.
