Article 30 of the French Code of Criminal Procedure

The Minister of Justice conducts the criminal policy determined by the Government. He ensures that it is applied consistently throughout the territory of the Republic.

To this end, he issues general instructions to the magistrates of the Public Prosecutor’s Office.

He may not issue them with any instructions in individual cases.

Each year, he shall publish a report on the application of the penal policy determined by the Government, specifying the conditions of implementation of this policy and of the general instructions issued pursuant to the second paragraph. This report is sent to Parliament. It may give rise to a debate in the National Assembly and the Senate.

Article 30

Le ministre de la justice conduit la politique pénale déterminée par le Gouvernement. Il veille à la cohérence de son application sur le territoire de la République.

A cette fin, il adresse aux magistrats du ministère public des instructions générales.

Il ne peut leur adresser aucune instruction dans des affaires individuelles.

Chaque année, il publie un rapport sur l’application de la politique pénale déterminée par le Gouvernement, précisant les conditions de mise en œuvre de cette politique et des instructions générales adressées en application du deuxième alinéa. Ce rapport est transmis au Parlement. Il peut donner lieu à un débat à l’Assemblée nationale et au Sénat.
