Article 311-10 of the French Cinema and Moving Image Code

By way of derogation from article 311-9, for the benefit of automatic aid, the minimum proportion of the initial contribution is reduced to:
1° 15% for works in the animation genre that meet the following conditions:
a) Be the subject of international pre-sales contracts for an amount at least equal to the difference between the amount of the initial contribution that would result from the application of a minimum proportion of 25% and the amount of the initial contribution actually made;
b) Obtain a minimum of 30 points for the “Creation” group and a minimum of 36 points for the “Production” group on the scale provided for in A or B of III of Article 311-44;
2° 20% for works belonging to the creative documentary genre when they are the subject of international pre-sale contracts for an amount at least equal to twice the difference between the amount of the initial contribution that would result from the application of a minimum proportion of 25% and the amount of the initial contribution actually made.
International pre-sales contracts are contracts concluded before the end of the shooting or, for works belonging to the animation genre, before the end of the production of the animation or, for works composed entirely of pre-existing images, before the start of editing, with a television service publisher, a publisher of on-demand audiovisual media services or another service giving or allowing access free of charge or for a fee to audiovisual content on individual request made by an electronic communication process, established abroad, either directly by the delegated production company established in France, or by the holder of the marketing mandate or the assignee of rights for the exploitation of the work abroad.

Article 311-10

Par dérogation à l’article 311-9, pour le bénéfice des aides automatiques, la proportion minimale de l’apport initial est ramenée à :
1° 15 % en ce qui concerne les œuvres appartenant au genre animation lorsqu’elles répondent aux conditions suivantes :
a) Faire l’objet de contrats de prévente internationale pour un montant au moins égal à la différence entre le montant de l’apport initial qui résulterait de l’application d’une proportion minimale de 25 % et le montant de l’apport initial effectivement réalisé ;
b) Obtenir un nombre minimum de 30 points au titre du groupe ” Création ” et un nombre minimum de 36 points au titre du groupe ” Fabrication ” sur le barème prévu, selon les conditions de réalisation de l’œuvre, au A ou au B du III de l’article 311-44 ;
2° 20 % en ce qui concerne les œuvres appartenant au genre documentaire de création lorsqu’elles font l’objet de contrats de prévente internationale pour un montant au moins égal au double de la différence entre le montant de l’apport initial qui résulterait de l’application d’une proportion minimale de 25 % et le montant de l’apport initial effectivement réalisé.
Sont considérés comme contrats de prévente internationale les contrats conclus, avant la fin des prises de vues ou, pour les œuvres appartenant au genre animation, avant la fin de la fabrication de l’animation ou, pour les œuvres intégralement composées d’images préexistantes, avant le début du montage, avec un éditeur de services de télévision, un éditeur de services de médias audiovisuels à la demande ou un autre service donnant ou permettant l’accès à titre gratuit ou payant à des contenus audiovisuels sur demande individuelle formulée par un procédé de communication électronique, établi à l’étranger, soit directement par l’entreprise de production déléguée établie en France, soit par le détenteur du mandat de commercialisation ou le cessionnaire de droits pour l’exploitation de l’œuvre à l’étranger.
